Premium Processing H-1B Petitions will be Adjudicated

USCIS Confirms that Petitions filed via Premium Processing will be adjudicated beginning April 28, 2014. As we noted in our April 10th Update, U.S. Citizenship and Immigration Services (USCIS) is in the process of sending Receipt Notices for H-1B petitions selected in the H-1B cap lottery filed via regular and premium processing.  We are forwarding these Receipt Notices to clients as we receive them from USCIS. The FY2015 H-1B Cap has been reached and a lottery will be conducted for all petitions received at USCIS from Tuesday, April 1 through Monday, April 7. Please note that any cases received at USCIS by close of business today will be included in the lottery. Cases selected in the lottery:  LAC will forward the receipt notice for any petitions selected in the lottery to the employee (via the employer) as soon as it is received. UPDATE: Fiscal Year 2015 H-1B Quota

The filing window for H-1B petitions subject to the fiscal year (FY) 2014 numerical cap will open on Tuesday, April 1, 2014.   The earliest start date of employment pursuant to these H-1Bs will be October 1, 2014. The visa numbers available remain unchanged: Regular/Bachelor's Cap:    68,000, with 6,800 reserved for applicants from Chile and Singapore pursuant to trade agreements with those countries. Master's Cap:   20,0000 for individuals who hold advanced degrees (Master's or higher) from a U.S. university. H-1B Cap Expected to be Reached Right Away

The FY2015 H-1B cap will open on April 1, 2014.  Informal reports indicate that the cap is expected to be reached right away.  USCIS has not made any predictions as to when the H-1B cap may be hit, but has indicated that it always plans for the possibility of the need to conduct a random lottery for petitions filed within the first 5 business days of April.
